{"id":69,"date":"2014-03-13T21:00:59","date_gmt":"2014-03-13T21:00:59","guid":{"rendered":"https:\/\/gayton-law.com\/?p=69"},"modified":"2014-03-13T21:00:59","modified_gmt":"2014-03-13T21:00:59","slug":"power-of-attorney-considerations","status":"publish","type":"post","link":"https:\/\/gayton-law.com\/?p=69","title":{"rendered":"Power of Attorney &#8211; Considerations"},"content":{"rendered":"<p>There are many reasons to create a Power of Attorney, which is, in effect an agreement outlining the relationship between a principal and an agent where the agent agrees to act on the principal&#8217;s behalf.<\/p>\n<p>Under general agency principals, an agent can be anyone who acts:<\/p>\n<p>1)\u00a0 On behalf of and be subject to the control of a principal;<\/p>\n<p>2)\u00a0 Solely with the authority conferred upon it by the principal;<\/p>\n<p>3)\u00a0 With due care and diligence;<\/p>\n<p>4)\u00a0 Only in the principal&#8217;s interest and not his or hew own interest;<\/p>\n<p>5)\u00a0 And is accountable for all funds collected or distributed on the principal&#8217;s behalf.<\/p>\n<p>An agent&#8217;s duties in Virginia can be found <a href=\"https:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+64.2-1612\" target=\"_blank\">here<\/a>.<\/p>\n<p>For purposes of a power of attorney, however, the principal should take extra care that the agent is trustworthy and reliable. This is especially true for older people, where financial abuse is showing annual losses of $2.9 billion for those one in every six adults over age 65 who have experienced such abuse, according to a MetLife <a href=\"https:\/\/www.metlife.com\/assets\/cao\/mmi\/publications\/studies\/2011\/mmi-elder-financial-abuse.pdf\" target=\"_blank\">study<\/a> conducted in 2011.<\/p>\n<p>Significant elder abuse cases lead to the establishment of the Elder Justice Act in 2010, which is the first Federal act to address elder abuse specifically.\u00a0 The law&#8217;s purpose is to develop and implement &#8220;strategies to decrease the likelihood of elder abuse, neglect, and exploitation.&#8221; It is part of the the <a href=\"http:\/\/www.gpo.gov\/fdsys\/pkg\/PLAW-111publ148\/pdf\/PLAW-111publ148.pdf\" target=\"_blank\">Patient Protection and Affordable Care Act<\/a>.<\/p>\n<p>The purpose and scope of a Power of Attorney document should be carefully constructed to protect the principal and her or his interests.
